Terms of service.
The hirer acknowledges that taking part in boating activities involves inherent dangers and risks, including but not limited to physical excursion, exposure to natural elements, boat capsize, sea-sickness, and encounters with natural wild life. All equipment supplied is used by the hire party at their own risk.
While Coromandel Boat Hire will take all practicable steps to identify and minimize potential dangers, it will not accept liability for loss, injury or damage sustained by a participant or his/her dependents in circumstances where such an event could not have been avoided by the exercise of reasonable care. The hirer agrees to release and indemnify Coromandel Boat Hire and staff against any liability they incur to anyone else, resulting from failure of the hirer to follow Coromandel Boat Hire instructions or the failure of any underage person accompanying them.
The hirer willingly accepts all the risks of boat hire including without limitation the risks described above and the possibility of personal injury, death, property damage or loss resulting there from for any reason. I accept that all Coromandel Boat Hire liability for loss of or damage to my property, disruption to travel plans, or mental injury is excluded. This exclusion is subject to any rights or remedies a customer has under the Consumer Guarantees Act 1993, or any other New Zealand law.
Coromandel Boat Hire reserves the right to cancel a hire if for a specific reason a vessel can not be made available for charter or due to adverse weather conditions.
If, at the charter commencement, Coromandel Boat Hire are not satisfied with the ability of the hirer to sail, handle, navigate and respect the charter vessel, or at any time during the charter period consider the vessel to be in an unsafe location, or if the actions of the renter is endangering the vessel, the occupants or any third party, Coromandel Boat Hire reserves the right to terminate the hire without refund and recall the vessel to any mooring or anchorage or point of shore which it considers to be secure.
At any stage during the hire, if the vessel fails in any way that is not due to operator error or use Coromandel Boat Hire will endeavour to fix or rectify the issue or replace a part. While the vessel is out of service, the renter will not be charged during this time.
Vessels must remain in the designated survey/agreed area at all times with numbers of people not exceeding the number allowed onboard under the vessel’s personal allocation.
Vessels must be secure and off the water one hour before sunset. Vessels must not manoeuvre within the hours of darkness unless in an emergency or with permission granted by Coromandel Boat Hire.
The hirer must adhere to current M.A.F. fishing regulations.
No animals/pets allowed on charter vessels.
No firearms allowed on charter vessels unless arranged prior.
Smoking is not permitted on any vessel.
All rubbish must be returned to shore for disposal.
The skipper or person in control of the vessel will not consume alcohol or any judgement impairing substances while in charge.
The vessel must at all times be under the control of the designated skipper.
The skipper must be a minimum of 18 years of age unless specifically agreed upon by Coromandel Boat Hire.
Everyone on board must abide by the Maritime Rules and Regulations.
The vessel must be returned as clean and tidy as it was on pickup or delivery. An additional $40 cleaning fee per vessel is applicable for vessels that require a significant clean by Coromandel Boat Hire.
Conditions of payment:
A booking is confirmed after the payment of the full hire fee for the agreed timeframe. If the hirer decides they wish to extend the hire and the vessel is available to do so, the additional amount is to be paid at the time of extension.
Security Bond
The security bond is to be paid by credit card/cash/Bank Cheque prior to taking possession of the vessel. Security Bond is $500. The security bond will be processed on the day of the termination of the charter. The following costs (if applicable) will be charged to your credit card or deducted from the Security Bond paid:
Loss or damage to charter vessel or equipment
Cost of refuelling the vessel. (If not done so by the hirer)
Defrayment of costs due to the vessel not being returned at the scheduled time. Extenuating weather conditions are exempt.
3. Insurance
All vessels are fully insured against fire, marine & collision risks third party liability. If during the charter period damage or loss is caused, the hirer is liable as follows:
To the full extent of loss and damage which in Coromandel Boat Hire’s opinion is not claimable against vessel insurers.
To pay the full excess on vessel insurance policy, where insurance is claimable
To pay the full amount of loss or damage should the claim be declined by the Insurance Company for any reason.
Note: These terms must be agreed upon before hire commencement. An unsigned rental agreement can result in the charter not taking place and no refund will be applicable.
